Sales, payment, delivery and request terms for Sarman 360 CRM / ERP packages and Sarman Soft custom software services.

1. Parties and scope

In this agreement, “Sarman Soft” means the seller/service provider identified above; “Buyer” means the individual or legal entity identified in the order or quotation form. A person acting for a company confirms their authority to represent it and the accuracy of billing and contact details.

Purchases for commercial or professional purposes are governed by applicable commercial and obligations law. If the transaction legally qualifies as a consumer transaction, mandatory provisions of Law No. 6502 and relevant legislation take precedence. Entering a company name on a form does not alone waive consumer rights.

2. Orders and pre-contractual information

A Sarman 360 order covers the Starter, Professional or Ultra package selected before payment, its listed modules and the selected licence duration. The order summary shows package, duration, software price, any discount, VAT, tax-inclusive total and instalment amounts. These details are read together with the Product Use Agreement and any buyer-specific written quotation/technical scope.

The Buyer may correct their details and selections before proceeding to payment. If a price changes, the old amount is not automatically charged; the current total must be reviewed again. Consent boxes are not preselected. Sending a project or contact form does not by itself create a paid order or payment commitment.

3. Nature of Sarman 360 packages

  • Starter: Access to selected core customer, task, account, product, warehouse and inventory management modules.
  • Professional: Includes the sales, service, field, finance and operations modules listed in the package comparison.
  • Ultra: Includes the expanded modules, including HR and manufacturing, within the scope stated in the catalogue.

The binding scope is the module list shown at the time of order and any separately approved technical quotation. Marketing visuals are illustrative interfaces; not every function shown is included in every package. Package content may not be changed retrospectively to reduce purchased rights.

4. Licence durations and perpetual licence

1-, 2- and 3-year options provide 12, 24 and 36 months of use respectively. Start and end dates are recorded at activation/delivery. Instalment count does not change licence duration. Renewal is approved separately under the new period's terms; this purchase does not authorise recurring card charges.

Unlimited Lifetime Licence means a perpetual licence to use the purchased Sarman 360 package, with no annual licence renewal fee for that same right of use. It does not mean transfer of source code or inclusion of all products not yet developed. Hosting, support and third-party service scope is determined by the package/quotation at purchase; paid extras are not added without the Buyer's approval.

5. Price, VAT and payment

List prices are in Turkish lira and exclude VAT. The tax-inclusive amount is calculated separately before payment. Online Sarman 360 payments through QNB Pay are based on 6 instalments, 0% interest and no additional payment commission charged to the Buyer . Card and bank eligibility is verified by the payment provider. An unapproved transaction is not a completed payment.

Rounding may cause a small difference in the final instalment; all six instalments total the tax-inclusive order amount. Late/default charges arising from the bank's card agreement are outside Sarman Soft's instalment offer. Sarman Soft does not request or store card numbers, CVV or 3D Secure codes in its order database.

6. Setup, delivery and training

After payment is verified, the project team agrees a setup, user account and training plan with the Buyer's authorised contact. Access credentials are sent to that contact and activation/delivery scope is recorded. Standard setup, training and support promised in the package are not charged separately. There is no physical shipment or shipping fee.

Business-specific data migration, additional development, new integrations, dedicated servers or on-site service are scoped, scheduled and priced with separate written approval. Delays in providing required access or data lead to a mutually revised schedule. If performance becomes impossible or agreed delivery cannot be met, the Buyer is notified; statutory notification, termination and refund periods apply to consumer transactions.

7. Custom software, mobile applications and web projects

The scope of custom CRM / ERP, iOS/Android apps, corporate websites and integration projects is defined by analysis, a technical quotation, screen/module list, working-hour budget and delivery plan. Hourly options on the website do not guarantee every project will be completed within the same time. Additional scope and hours require the Buyer's prior approval.

Unless otherwise agreed in writing, custom project payments are made by bank transfer as 40% upfront, 40% when both parties confirm 50% of the project scope is complete, and 20% on delivery . The Sarman 360 card offer does not automatically apply to custom projects. Project source code and technical documentation are delivered once agreed delivery and payment conditions are met. Third-party component licences and the scope of intellectual property rights are addressed separately in the project contract.

8. Withdrawal rights and digital service exceptions

In consumer transactions, unless a statutory exception applies, consumers may withdraw from the service contract within 14 days without giving a reason or paying a penalty . Notice may be sent by email to info@sarmansoft.com.tr or in writing to the company address; no specific form is required.

Statutory exceptions for services performed instantly electronically, intangible products delivered instantly, and services begun with the consumer's approval before the withdrawal period expires apply only where the particular transaction meets their conditions. Accepting this agreement alone is not consent to early performance or a waiver of withdrawal rights. Where necessary, an early-start request and the related information are obtained separately. Describing software as “custom” or “digital” does not automatically remove all refund rights.

For valid withdrawal from a service, refunds are made within the statutory period after receipt of notice, generally 14 days, using the appropriate original payment method without cost to the Buyer. Banks may differ in how refunds appear on statements. Cancellation of commercial purchases is assessed under the written project/sales agreement and applicable law.

9. Defects, incomplete performance and support

Non-conformity with the order, a non-working module or incomplete delivery may be reported to the support centre or by email. Including the package, order number, reproduction steps and screenshots without personal data helps resolution. A withdrawal exception does not remove statutory rights arising from defective goods/services. Consumers retain their statutory remedies.

10. Records, personal data and communication

The accepted contract version, acceptance time, selected package/duration and pricing are linked to the order record. Contract pages can be printed or saved as PDF; order records may be requested through our contact address. Personal data processing is explained in the separate Personal Data Notice. Acceptance of the sales agreement is not marketing consent.

11. Disputes and precedence

You may first contact us, but this is not a prerequisite to applying to competent authorities. Consumer arbitration committees, consumer courts and, where required, mediation apply within current monetary thresholds and procedural conditions. Commercial disputes follow the relevant jurisdiction rules. A provision contrary to mandatory law does not affect the remaining provisions. Later text changes do not retrospectively reduce rights under earlier orders.
